1. General Regulations

 

1.1. The “National Russian Motorcycle Federation” (further referred to as the Federation) is a voluntary public sports union of the Russian citizens established for protection of their common interests, achieving common goals, exercising the rights and legal interests that gain developing motorcycle sports and tourism in the Russian Federation.

The Federation’s activity bases on the principles of voluntary society, equal rights for its members, self-management, legality, publicity.

1.2. The Federation’s constantly acting management body – the Board – is located in the Moscow city.

1.3. The Federation provides its activities corresponding to the Constitution and the legislation of the Russian Federation currently in force, to the given Statues, to the internationally admitted norms, regulations and standards. The Federation admits the Olympic movement ideas, the International Motorcycle Federation (FIM) and the European Motorcycle Union (UEM) regulations.

1.4. Federation coordinates its members motorcycle sport and tourism organizational and management activity. The Federation itself according to established order carries out every procedure dealing with: official awarding and ranking during its activities in any motorcycle discipline; determining any technical, financial conditions and rules for its activities, bound up to awarding, concerning also sponsorship, advertising  and TV-highlighting.

1.5. After Ministry of Justice registration the Federation becomes a legal entity: it has its own property, that is to cover the Federation liabilities, it can buy and exercise property rights and personal non-property rights, it can take responsibility, act as petitioner and as defendant in a court, court of arbitration and arbitration tribunal.

The Federation has its own balance, settlement, currency and other accounts in banks and other credit institutions, its official name, seal, stamps, letterheads, flag, emblem and other symbols and attributes legally adopted and registered.

1.6. The Federation is not responsible for any liabilities of the Russian Federation, as well as the Russian Federation is not responsible for any of the Federation 's liabilities.

1.7. The Federation is not responsible for any liabilities of its members, as well as the members are not responsible for any of the Federation's liabilities.

1.8. To provide the Federation’s interests the Federation carries out its activity in cooperation with federal, regional and local governments. The Federation has peer-to-peer contacts with foreign, Russian and international Organizations. The Federation can acquire membership in Unions, Associations, Federations and other Organizations on voluntary bases in and out Russian Federation on conditions that do not contradict the given Statues and the legislation currently in force.

1.9. The Federation carries out its corresponding to the Statues goals activity on the territory covering more than half regions of the Russian Federation.

1.10. The Federation’s full official name in Russian is Общероссийская общественная организация «Национальная Российская Мотоциклетная Федерация»; short – «НРМФ».

The Federations official name in English is «National Russian Motorcycle Federation».

 

2. Principal goals and objectives

 

2.1. The Federation is grounded with principal goals to develop motorcycle sports and tourism in the Russian Federation; to further joining of Russian citizens who fond of motorcycle, snowmobile, multi-wheel motovehicles, motorcycle sport and tourism; to strengthen international moto-cooperation; to raise the meaning of the physical culture and sports in developing wide- and balanced-educated persons, in educating physically strong and morally healthy generation.

2.2 The Federation objectives are:

- organization and carrying out competitions for every motorcycle sport and tourist discipline in the Russian Federation, competitions marketing;

- issuing regulations for its members concerning motosport and mototourism; Russia-wide motosport and mototourism activities schedules; regulations for Championships, Cups and other sport and tourist activities; regulations for required competitions, trainings and practice material basis;

- introducing the technical culture, that motorcycle sport brings, into children and young people education, involving children and youth in active motorcycle sport, growing up psychologically, physically and morally healthy young generations educated in technical questions by involving young people in public motosport, mototourism and other motorcycle activities, using the means of physical trainings and motosport for preparing them to protect their motherland;

- supporting and developing child and adolescent motorcycle schools, unions and other forms of youth sport motorcycle movement;

- to help the Russian industry in designing and production introducing of high quality sport motorcycle vehicles;

- restoring Russian highly qualified sport instructor and coach personnel and the system for their training that meets the demand to carry out high quality and safe competitions in every motorcycle discipline;

- cooperation with organizations that have to use motorcycle in their professional activity, helping to make traffic driving safer;

- working out safeguard measures for competitions, ecology standards and standards for sport constructions, for technical and personal sport equipment;

- establishing funds for aiding injured motorcycle sportsmen and helping their rehabilitation, social defence of sportsmen, coaches, referees, other specialists, motosport veterans;

- taking part in developing standards for including them into official Russian Sport Qualification Standards (RSQS) in motosport;

- considering individuals motorsport results and submitting them for approval according to prescribed order for awarding with grades, ranks, categories according to RSQS.

 

3. The Federation’s rights and duties

 

3.1. For achieving its goals Federation, according to legislation currently in force, may exercise the following rights:

- to represent and to defend its members interests in state and local government bodies and in public unions;

- to give publicity to its activities freely;

- to participate in the governmental (state and local) process of working out decisions concerning physical culture and sports;

- to initiate and hold conferences, meetings and carry out other activities to exercise the Federation legal rights;

- to create for main Federation activities committees, commissions, councils, boards which work is ruled by regulations adopted by the Federation Board;

- to carry out legal entrepreneurial activity corresponding with the Statues goals in the Russian Federation and abroad;

- to define independently its inner structure, forms and methods of activity, budget and personnel stuff;

- to define and to receive membership fee and any kind of fees;

- to provide services in teaching motodriving basis, in repairing motovehicles, inventory and equipment, to teach and train sportsmen, trainers, race directors and referees for every motorcycle discipline;

- to work out and to improve motosport safety measures;

- to involve Russian and foreign specialists in carrying out scientific researches;

- to provide inner licensing for sportsmen, trainers, referees, other Federation members and  persons participating in the Federation activities;

- to stimulate the Federation members active work, to solicit the international motorcycle federations and other organizations, Russian sports and other government bodies for people in awarding them with honor grades and rewards;

- to establish mass media, to carry out publishing business to provide motorcycle movement interests, and to create and distribute using all legal technical means (Kino, TV, Audio, Video etc.) products and software corresponding to the Federation goals;

- to create, purchase, alienate to put and to get at disposal or lease buildings, constructions, equipment, vehicles, inventory and all other kinds of property that is necessary to provide the Federation activities materially, and write the property off the balance when it is depreciated or outdated;

- to determine the compliance of sport constructions and motorcycle courses to the terms for carrying out any level competitions in every motorcycle discipline;

- to be involved in organizing designing, production, purchasing, distribution, sells and rent of motorcycle vehicles and sportsware necessary for motosport development.

- to carry out Russia-wide and international competitions, to recruit and to train the Federation first teams for all motorcycle disciplines;

- to help carrying out sport and recreation activities, to initiate an to hold these activities;

- to provide according to the legal order sport and health-keeping services;

- to be involved in producing and distributing of official, memorial symbols and awards with the Federation Emblem and other corresponding attributes.

- to maintain peer-to-peer international contacts with charity, cultural, sport organizations, to make corresponding agreements, to participate in international symposiums, conferences, exhibitions;

- to hire administration stuff on regular bases regulated by labor and social insurance legislation;

- to create database on motosport technique history and development;

- to organize, to participate, to give any help to exhibitions and museums of motorcycle technique (in private, public or any kind of property), to meetings, motorcycle runs, parades devoted to motorcycle technique;

- to be involved in initiating and carrying out youth summer recreating programs;

- to be involved in initiating and carrying out different youth programs: creative, sport and tourist, patriotic, educational, professional etc.;

- to participate in organizing and carrying out of exhibitions, fairs, festivals and other activities.

After getting special licenses in prescribed by the Russian Federations legislation order the Federation is legal to carry out the activities that are to be licensed.

3.2. The Federation is obliged:

- to follow the Russian Federation legislation, universal principles and standards of the International Law and standards and principles established be the given Statues;

- to publish the property usage report annually or make the named report to be easy to get acquainted with;

- to inform annually the government body that registered the Federation of continuing its activity, of permanently acting management body name and placement, of administration personal data needed for legal entities official registry;

- to submit on demand of the government body that registered the Federation documents confirming management bodies’ and the Federation authorities’ decisions;

- to let the representative of the government body that registered the Federation present at activities carried out and render him assistance in getting acquainted with the Federation activities meaning their correspondence to the Statues goals and the Russian Federation legislation.

 

4. Establishing a Federation. Members’ rights and duties

 

4.1. The Federation may be established by persons – citizens of the Russian Federation over 18 years old.

4.2. The founders of the Federation are its members from the moment the Federation is Established. They have equal rights and duties.

4.3. The membership in the Federation is voluntary.

4.4. The following persons may become the Federation members:
Russian citizens, foreigners and persons without citizenship over 18 years, and public unions that are legal entities, having interest and intention to achieve Statues principal goals and objectives, taking part in the Federation activities and paying membership fee.

4.5 The Board of Regional branch of the Federation on basis of written application form carries out admission into the Federation for a person. The Board of the Federation on basis of prescribed documents and written application forms carries out admission into the Federation for a public union that is legal entity.

4.6. The members of the Federation pay membership fee that is established by the Board. A person becomes a member of the Federation after the decision is made by the Board of Regional branch of the Federation and entrance and membership fees are paid, a public union that is legal entity becomes a member of the Federation after the decision is made by the Board of the Federation and entrance and membership fees are paid.

4.7. The member of the Federation has the right to:

- elect and be elected to the Federation management and auditing bodies;

- take part in every activity carried out by the Federation;

- take part in working out and carrying out the Federation projects and programs;

- use the Federation educational, methodic, scientific, information developments;

- acquire the Federation help while defending his (its) personal social rights;

- take part in discussions, concerning member rights and duties;

- receive information on every activity carried out by the Federation;

- submit proposals concerning Federation activities to every body of the Federation;

- leave the Federation voluntary;

- exercise one’s rights personally or through representative.

4.8. The Federation members are obliged to

- follow the Federation Statues;

- contribute to achievement the Federation goals;

- pay membership fee in time;

- be subject to the Federation administration’s decisions;

- take care for the Federation property;

- do other duties according to the Statues and the legislation currently in force.

4.9. The membership in the Federation is canceled:

- according to the wish of the member;

- when the member is expelled the Federation.

In case of voluntary decision the Federation membership is canceled after the body that accepted the member to the Federation receives his written notification.

The member can be expelled from the Federation in case of:

- ignoring the decisions or other adopted regulations of the Federation's managing bodies;

- not paying or not-in-time paying membership fees;

- taking any actions that might harm the image of the Federation, breaking the sport ethics norms;

- other ways in which member actions break requirements established by the given Statues and contradict the Federation goals and tasks.

A person, a public union that is a legal entity loses the Federation membership in case of the body that accepted the member to the Federation works out the expel decision.

4.10. Sportsmen, trainers, referees, specialists, public figures, veterans, who contributed much to motosport developing in the Russian Federation, can become Honorable members. Honorable membership is bestowed by the Conference decision.

4.11. A member can become the Federation Veteran due to formal comparison of his personal data to parameters established in the Veteran regulations approved by the Federation Board. The Veteran status should be confirmed by the Veteran Council.

 

5. The Federation's Structure

 

5.1. The Federation carries out its Russia-wide activity according to its goals through its structural units – Regional branches (the Federation Branches).

5.2. The Federation Branches are structural units of the Federation created according to the Russian Federation legislation. They carry out their activities basing on the given Statues or the Statues of their own that do not contradict the Federation Statues. The Federation Branch can become a legal entity in the legally established order.

The public unions of motorsport veterans representing regions of the Russian Federation created according to the law regulating public unions can be the Federation members having every member right.

5.3. The Meeting is the superior body of the Federation Branch that carries out its activities basing on the Federation Statues. The Meeting is held at least once in a year.

The Meeting is considered legitimate if more than 1/2 (one half) of its members are present. The decisions are taken by simple majority of the votes taking part in the Meeting. The way of voting (open voting or secret ballot) is determined by the Meeting.

The special Meeting is initiated by the Regional Branch Board on the Chairman’s decision, or not less than one third of all the Regional Branch's members demand it, or by the Regional Branch Auditor (Auditing commission).

5.4. The Meeting may work out decisions concerning any Regional Branch's activities. The meeting elects: the Regional Branch Chairman – once in 2 years, the Regional Branch Board from its members –once in 2 years. The Regional Branch Board is a governing body of the Regional Branch in between the Meetings. The Regional Branch Board elects delegates to the Conference.

5.5. The Regional Branch Board may be once reelected.

5.6. The field of the Regional Branch Board 's competence includes:

- exercising legal entity rights and duties in case of governmental registration;

- dealing with the process of initiating and preparing the Regional Branch Meeting

- managing the Regional Branch’s property and assets;

- dealing with controversial points, complaints and proposals from the Regional Branch members;

- accepting the Regional Branch budget;

- dealing with other questions bound to current Regional Branch activities that do not cross the Regional Branch Meeting field of competence;

5.7. The Regional Branch Chairman:

- manages the Regional Branch current activities;

- acts on behalf of the Regional Branch without the warrant document, signs up the Regional Branch’s documents;

- organizes fulfilling the Federation management bodies’ and the Regional Branch’s decisions  in the represented region;

- manages the Regional Branch’s assets in the limits of the expense budget adopted by the Regional Branch Board;

- carries out activities to reach the Federation goals;

- makes other necessary decisions concerning the Regional Branch’s current activities that do not cross the Regional Branch Meeting  and Board competence.

5.8. The Regional Branch Auditor (Auditing commission) acts corresponding to the regulation adopted by the Regional Branch Board.

5.9. When carrying out their activities structural units are to correspond to the Constitution of the Russian Federation, the Laws and other Russian Federation legislative documents, the given Statues and to decisions made by the Federation management bodies in accordance to the Statues.

5.10. To provide organizational and methodical mechanism for Regional Branches cooperation, for organizing and carrying out interregional competitions, for working out other decisions corresponding to the Federation’s motosport and mototourism regional activities, the Federation may establish Branches, Interregional coordination centers that act according to regulations adopted by the Federation Board.

 

6. The Federation's Management and Auditing bodies

 

6.1 The Conference is the superior body of the Federation. It is initiated by the Federation Board. It can be regular, regular-elective and special (further together they are treated as The Conference). The regular Conference is held once in a year. The regular Conference serves for accepting the Federation Board, President and Auditing commission reports. The regular-elective Conference is held once in every 4 years.

The special Conference is initiated by the Federation Board on the Federation President decision, or not less than one third of all the Federation's members demand it.

The place and time for the Conference to take place are defined by the Federation Board.

Members of the Federation committees and commissions, representatives from organizations supporting the Federation can be invited to participate in the Conference.

The Conference is considered legitimate if more than 1/2 (one half) of its Regional Branches delegates are present. The decisions are taken by simple majority. To take a decision in the field of the Conference competence, more than 2/3 of the votes taking part in the Conference are required. Every delegate of the Conference has only one vote.

The way of voting (open voting or secret ballot) is determined by the Conference. Invited guests have the right to participate in discussions.

The Federation’s members, taking part in the Conference, pass the registration in the special commission elected by the Conference.

The Federation President or a Vice-president charged by The Federation President may be the chairman at the Conference.

6.2. The field of the Conference's competence includes:

- accepting and making amendments to the Statutes;

- electing the President and Vice-presidents of the Federation, members of the Board, and their withdrawal;

- electing the Federation Auditing commission to act for 4 years and their withdrawal;

- defining the major tasks and priorities for the Federation,   and approving long-term programs and plans, defining the principles of purchasing and exercising the Federation property;

- accepting the Federation Board, President and Auditing commission reports;

- working out decisions on reorganizing and liquidation of the Federation.

6.3. The Conference may work out decisions concerning any other questions.

The Conference is held according to the accepted agenda. The Conference decisions are to be fulfilled by the Federation management bodies and members.

6.4. The Federation Board is a governing body of the Federation in between the Conferences. The Federation President is the chairman at the Board.

The Federation Board is constantly acting collective management body that exercises the rights of legal entity on behalf of the Federation and does the Federation duties corresponding to the Statues and to the legislation currently in force. The number of the Federation Board members, the Federation Board election and recalling order are defined by Conference. The Federation President and Vice-presidents are the Federation Board members.

6.5. The Federation Board members can be recalled before end of term by the Conference decision – more than 1/2 of the votes taking part in the Conference are required, and by their own application.

If the Federation Board member is recalled before end of term, the Federation Board on representation of a person made by the Federation President may include another member instead with consultative vote until the member is re-elected on the regular Conference.

6.6. The Federation Board is considered legitimate if more than 1/2 (one half) of its members are present. The decisions are taken by simple majority. The way of voting is determined by the Federation Board.

The Federation Board meetings are held when needed but at least twice in a year. The Federation President is the chairman at the Federation Board meeting. If the Federation President is absent the First vice-president or a Vice-president may be charged by the Federation President to be the chairman.

6.7. The Federation Board:

- takes the decision to hold the Conference, defines the Conference agenda, date, place and the representative quota;

- reports on the carried activities before Conference;

- controls the Statues observance and the Conference decisions implementation;

- approves one of Vice-presidents as the First vice-president on a proposal from the Federation President;

- approves the Federation Secretary general on the Federation President representation;

- carries out admission into the Federation for a public union that is legal entity and their withdrawal;

- works out plans and programs for carrying out activities for providing the Conference decisions implementation;

- considers the ways of using the Federation’s property, approves the Federation expense and income budgets;

- makes up the decisions to enroll and to withdraw from federations, associations, other unions;

- makes up the decisions to establish commercial legal entities;

- appoints chairmen for commissions, committees, councils on proposal from the Federation President;

- approves commissions, committees, councils for motorcycle disciplines and their members on proposal from their chairmen;

- approves schedules for Russia-wide and international competitions that take place in the Russian Federation, for trainings, seminars and other activities;

- approves the Federation first teams, their trainers in different motorcycle disciplines, plans of preparing for official international competitions;

- approves the Federation’s championships’, cups’, competitions’ results in motorcycle disciplines;

- approves the Federation’s regulative documents in motorcycle disciplines and control their observance;

- approves regulations and other documents regulating the Federation management bodies’ activity;

- considers the documents for awarding with the Federation’s honorable sportsman grades and referee categories;

- approves samples for the Federation’s seal, stamps, the emblem, attributes, pennant, the flag, identity cards, certificates and diploma;

- defines the amount of entrance, membership and other fees (e.g. competition participant fee) and different tariffs;

- coordinates the Federation members’ activities, deals with controversial points and conflicts;

- approves the Federation budget, introduces amendments into the budget;

- appoints on a proposal from the Federation President the Executive director and defines the Executive director’s field of competence.

The Federation Board has the right to deal with other questions that do not belong to the Conference field of competence.

6.8. For regulating the current activities the Federation Board elects its members to the Federation Board Bureau (the Bureau) lead by the Federation President. The Bureau members number and field of competence are defined by the Federation Board. The Federation President initiates the Bureau meetings to make decisions on current activities important questions. The Bureau informs the Federation Board of its decisions members as soon as possible. The Bureau’s decisions are approved at the Federation Board’s nearest meeting.

6.9. The Bureau has the right to receive from the Regional Branches every necessary data, concerning the Regional Branches’ activities gained to fulfill the Conference decisions and the Bureau’s decisions.

6.10. The Federation President manages the Federation in common.

The candidate to run for the Federation President post should apply not later than 2 months before the Conference.

The Federation President may run for a new term without any limitations.

The Federation President:

- manages the Federation's, the Federation Board’s, the Bureau’s current activities, is responsible before the Conference and the Federation Board;

- carries out the representative functions;

- is the chairman at the Conference, the Federation Board, the Bureau;

- without the warrant document represents the Federation interests in state and local governmental bodies, public, international and other organizations, personal contacts;

- issues the warrant documents;

- manages the Federation’s real estate and other assets, makes deals and juridical actions in the defined by the Federation Board budget limits;

- has the right to sign financial and administrative documents;

- to the Federation benefits makes in coordination with the Federation Board members decisions concerning any current Federation activity, the decisions are to be approved at the Federation Board;

- carries out, considering the legislation currently in force, any juridical and real actions necessary for achieving the Federation goals excepting the questions, that according to the given Statues belong to the fields of the Conference, the Federation Board competence.

6.11. The First vice-president:

if necessary acts temporary as the Federation President on the ground of written Federation President’s charge.

6.11. The First vice-president and vice-presidents:

assist the Federation President in doing the Federation President’s duties, are responsible for the entrusted by the Federation President fields of activity.

6.13. The Secretary general:

is in charge of running the Federation Secretariat, is the Federation Board and the Bureau member without right to vote. The Secretary general works corresponding to the Secretariat regulations approved by Federation Board.

6.14. To control the Federation’s activity the Conference elects Auditing commission that carries its activity according to the Auditing commission regulation adopted by the Federation Board.

The Auditing commission audits the Federation’s activity annually, initiates the audit itself or on the Conference’s, the Federation Board’s, the Federation President’s charge. The members of the Auditing commission have the right to demand from the Federation authorities necessary documents and personal explanations.

The members of the Auditing commission can not be at the same time the members of the Federation’s management bodies.

6.15. Commissions, committees, councils in every motorcycle discipline carry out their activities corresponding to their inner regulations approved by the Federation Board.

6.17. The Veteran Council:

uses its rich experience to assist the Federation Board and commissions.

The Veteran Council regulation is approved by the Federation Board. The Veteran Council’s chairman elected at the Veteran Council meeting is the Federation Board’s member and occupies a Vice-President Post.

 

7. The Federation's property and its sources

 

7.1. The Federation may own land, buildings, vehicles, equipment and any other property and assets needed to provide its activity materially.

7.2. The Federation may own publishing houses, mass media established and bought at the expense of the Federation in correspondence with the Statues goals.

7.3. The Federation's property sources

- entrance, membership, purpose and other fees;

- voluntary donations;

- income from lectures, consulting, seminars, competitions and other activities, from publishing and distributing of printed materials;

- income from any kind of commercial activity at home and abroad;

- any legal according to the legislation currently in force incomes.

7.3. This property may be acquired with the help of the Federation's own finances, as well as by giving, inheriting or by any other legal way.

7.4. Entrance, membership, purpose and other fees, donations are not the subject to return.

7.5. The Federation as the whole owns its property. The single member can not own the part of the Federation’s property.

7.6. The Regional Branches basing on the given Statues, have the right to operatively manage the property, assigned to them by the Federation. The Regional Branches basing on their own Statues are the owners of their property.

7.7. The Federation carries out entrepreneurial activity only in correspondence with achieving the Statues goals.

7.8. The Federation has the right to make deals and other juridical actions on behalf of itself in the Russian Federation and abroad corresponding to the legislation currently in force.

7.9. The Federation can establish commercial units, buy property used for commercial activity. Commercial organizations established by the Federation pay taxes and have duties according to the Russian Federation legislation.

7.10. The Federation’s commercial revenue is not the subject for redistribution between members, it may be used only for achieving the Statues goals.

7.11. The Federation has the right to use its assets and property for charity.

 

8. The Federation’s symbols

 

8.1. The federation has in established order:

- the flag, emblem, marketing logo, pennant, counters, medals, certificates, diplomas, special symbols, awarding attributes with the Federation’s emblem and symbols;

- the seal, stamps, letterheads for official papers;

The usage, samples and sketches for the mentioned symbols are approved by the Federation Board and are registered in established order.

 

9. The procedure of the Federation's reorganization and liquidation

 

9.1. The Federation may be reorganized or liquidated according to the Conference decision or in other legal order according to the Russian Federation legislation.

9.2. To take a decision on reorganization or liquidation not less than 2/3 of the votes taking part in the legitimate Conference are required.

9.3. The reorganization (in any form) of Federation is carried out according to the legislation currently in force.

9.4. The Federation can be liquidated by the Court decision.

9.5. In case of liquidation the Liquidation commission is created in prescribed order.

9.6. The Federation’s property and assets remaining after liquidation according to the Conference decision, after satisfying the creditors, are used for the given Statues goals.

9.7. The decision concerning the usage of the remaining property is published by the Liquidation commission in the Press.

9.8. The Federation provides the audit and preserving documents for hired personnel stuff and in case of liquidation passes the documents in prescribed order for state keeping.

9.9. The Federation’s liquidation decision is sent to the government body that registered the Federation for excluding from the legal entities official registry.
